Know Your Rights
Florida Personal Injury Law, Explained
Florida's injury laws changed significantly in 2023. If you've read older articles online, some of what you learned may no longer apply. Here's what governs a Boca Raton injury claim today.
Proving Negligence
To recover compensation, you must show four things: the other party owed you a duty of care, they breached that duty, the breach caused your injury, and you suffered actual damages. Most of our work goes into proving causation and damages, since that's where insurers push back hardest.
Filing Deadlines
| Claim type | Deadline | Statute |
|---|---|---|
| General negligence (car crashes, falls, most injuries) | 2 years from the injury, for claims arising on or after March 24, 2023 | Fla. Stat. §95.11(5)(a) |
| Wrongful death | 2 years from the date of death | Fla. Stat. §95.11(5)(e) |
| Medical malpractice | 2 years from when the injury was or should have been discovered, with outer limits | Fla. Stat. §95.11(5)(c) |
| PIP benefits from your own insurer | Seek medical treatment within 14 days of the crash | Fla. Stat. §627.736(1)(a) |
Before 2023, Florida allowed four years for most negligence claims. That window is now half as long, and missing it almost always ends the claim.
Florida's Comparative Fault Rule
For cases filed after March 24, 2023, Florida Statutes §768.81(6) bars recovery if you are found more than 50 percent at fault for your own injuries. At 50 percent or less, your award is reduced by your share of fault, so someone found 30 percent responsible for a crash keeps 70 percent of what the claim is worth. Insurers know this rule well, which is why they often try to shift blame to the injured person early in a claim. Medical negligence cases are an exception and still follow pure comparative fault.
PIP and the Permanent Injury Threshold
Florida requires every registered vehicle owner to carry $10,000 in PIP coverage, which pays a portion of medical bills and lost wages regardless of fault. Without a diagnosis of an emergency medical condition, PIP medical benefits are limited to $2,500. To recover pain and suffering from the at-fault driver after a car crash, your injury must meet the threshold in §627.737(2): a significant and permanent loss of an important bodily function, a permanent injury, significant and permanent scarring or disfigurement, or death. Medical documentation is what proves the threshold, which is why consistent treatment matters.
Types of Damages
| Type | What it covers | How it's proven |
|---|---|---|
| Economic | Medical bills, future care, lost wages, lost earning capacity, property damage | Bills, pay records, expert projections. Since 2023, §768.0427 limits how medical expenses are proven, so billing records need careful handling. |
| Non-economic | Pain, suffering, emotional distress, loss of enjoyment of life | Medical records, your testimony, family and witness testimony |
| Punitive | Punishment for intentional misconduct or gross negligence, such as some drunk driving crashes | Clear and convincing evidence under §768.725. Awards are capped under §768.73 in most cases, but the caps do not apply to a defendant who was under the influence of alcohol or drugs (§768.736). |

First Steps
What to Do After an Accident in Boca Raton
The steps you take in the first few days protect both your health and your claim.
- 1Get medical care right away if you're hurt. Call 911 for serious injuries. Some injuries take time to show up, so pay attention to how you feel in the days after a crash. If you do need treatment, keep in mind that Florida PIP benefits require it within 14 days.
- 2Report the crash. Florida law requires reporting any crash involving injury, death, or at least $500 in property damage (§316.065). In the city, that's Boca Raton Police Services; on I-95 or the Turnpike, it's usually the Florida Highway Patrol.
- 3Photograph everything. Vehicles, the scene, road conditions, and visible injuries.
- 4Get witness names and phone numbers. Witnesses are hard to find weeks later.
- 5Notify your own insurer, but don't give a recorded statement to the other driver's insurer. Your attorney can handle that conversation for you.
- 6Keep every record. Bills, receipts, missed-work notes, and correspondence.
- 7Talk to an attorney before accepting any settlement. Once you sign a release, the claim is closed.

Boca Raton Personal Injury FAQ
Nothing upfront. We work on a contingency fee, so our fee is one-third (33.3%) of the compensation we recover, and you owe no attorney fee if we don't recover. Case costs such as filing fees, records, and experts are deducted from the recovery; if there is no recovery, they are waived. Florida Bar Rule 4-1.5 sets maximum contingency percentages for personal injury cases, and you'll receive a written Statement of Client's Rights before you sign anything.
For cases filed after March 24, 2023, Florida bars recovery if you are more than 50 percent at fault for your own injury (§768.81(6)). If you are 50 percent or less at fault, you can still recover, reduced by your percentage of fault.
For most negligence claims arising on or after March 24, 2023, you have two years from the date of injury (§95.11(5)(a)). Wrongful death claims also have two years from the date of death.
No. PIP pays 80 percent of reasonable medical expenses and 60 percent of lost income, up to a $10,000 total, and only $2,500 for medical care without an emergency medical condition diagnosis. Anything beyond that comes from the at-fault driver's liability coverage or your own uninsured motorist coverage.
Yes, if your injury meets Florida's permanent injury threshold under §627.737(2). That includes permanent injury, significant and permanent loss of an important bodily function, or significant and permanent scarring or disfigurement. Even if your injury doesn't meet the threshold, you can still claim medical bills and lost income beyond what PIP pays.
Florida doesn't require drivers to carry bodily injury liability coverage, so this is common. Your own uninsured/underinsured motorist coverage is often the main source of recovery, and we handle those claims against your insurer.
Most cases settle without a trial. We prepare every case as if it will go to trial, because insurers pay more when they know a firm is ready. If your case is filed, it will usually be in Palm Beach County's Fifteenth Judicial Circuit.
Many cases resolve within six to eighteen months. Cases that go into litigation often take eighteen to thirty-six months, depending on injury severity and how hard the insurer contests liability.
